Terms and Conditions

These Terms and Conditions apply to purchases made through the Dobrawa Szmyt Designs website. Please read them before placing an order.

By placing an order through this website, you agree to these Terms and Conditions. Nothing in these terms affects your statutory rights as a consumer.

Products

I aim to describe and photograph each piece of jewellery as accurately as reasonably possible.

Much of my jewellery is individually handmade. Small variations, tool marks and other characteristics of hand-making may therefore occur and form part of the individual character of a piece.

Natural gemstones, pearls and other natural materials may vary in colour, pattern, shape, inclusions and surface characteristics. These natural variations are not faults.

Colours may also appear slightly different depending on lighting, photography and the screen or device used to view the website.

Any important dimensions, materials and other relevant product information will be included in the individual product description where applicable.

Prices

Prices are shown in pounds sterling (£).

The price applicable to an order is the price displayed when the order is placed, subject to correction of any obvious error.

Delivery charges are shown separately where applicable and will be displayed before you complete your purchase.

Placing an order

When you place an order, you are making an offer to purchase the item or items in your basket.

You will receive an electronic acknowledgement after placing your order. An order is accepted when I confirm that it has been accepted or dispatched.

If I am unable to accept or fulfil an order, I will contact you and any payment already taken for the unavailable item will be refunded.

I  reserve the right not to accept an order before a contract has been formed. This may happen, for example, if an item is no longer available, has been sold elsewhere, I discover a significant error in the product description or price, or I discover that an item is damaged or unsuitable for sale. If payment has already been taken, the relevant amount will be refunded.

Payment

Payment must be made using one of the payment methods offered at checkout.

Payments are processed through the payment providers available on this website. I do not directly receive or store your full card details.

Delivery

Available delivery methods, charges and any applicable delivery restrictions will be shown at checkout.

Estimated dispatch or delivery information may also be provided on individual product pages or during checkout.

I will take reasonable care to dispatch orders within the stated timeframe. Unless another delivery period has been agreed with you, goods will be delivered within the period required by applicable UK consumer law.

Please make sure that the delivery information supplied with your order is complete and accurate.

Handmade and one-of-a-kind jewellery

Some pieces offered by Dobrawa Szmyt Designs are unique or made in very small numbers.

For this reason, if an individual piece becomes unavailable, it may not be possible to provide an identical replacement.

Jewellery sizing

Where a jewellery item has a specific size, such as a ring or bracelet, the size will be stated in the product information where applicable.

Please check sizing information carefully before ordering.

If a customer selects or supplies a particular size, Dobrawa Szmyt Designs is not responsible if an item is unsuitable because the customer selected or supplied an incorrect size. This does not affect any statutory right to cancel an eligible online purchase or any rights relating to faulty or misdescribed goods.

Your statutory cancellation and other consumer rights are not affected by this section.

Cancellations, returns and refunds

Your rights regarding cancellation, returns and refunds are explained in the Refund and Returns Policy available on this website.

For eligible online purchases, UK consumers normally have a statutory right to cancel within 14 days after receiving the goods. Further information about exercising this right and returning goods is provided in the Refund and Returns Policy.

Personalised and custom-made items

Where jewellery is made to your specifications or is clearly personalised for you, the normal statutory right to cancel because you have changed your mind may not apply.

This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.

Faulty or misdescribed goods

Goods supplied must comply with your statutory rights, including requirements that they are as described, of satisfactory quality and fit for purpose where applicable.

Nothing in these Terms and Conditions or elsewhere on this website excludes or restricts those rights.

If you believe there is a problem with an item you have received, please contact hello@dobrawaszmytdesigns.co.uk.

Caring for your jewellery

Appropriate care can help preserve the appearance and condition of jewellery.

Any specific care information relevant to a particular piece or material may be supplied with the jewellery or included in its product description.

Normal wear, ageing, tarnishing or changes arising from use are not necessarily manufacturing faults. This does not affect your statutory rights where an item is faulty.

Intellectual property

Unless otherwise stated, the original photographs, written content and original jewellery designs displayed on this website are owned by or licensed for use by Dobrawa Szmyt Designs.

They may not be reproduced or used commercially without permission except where permitted by law.

Liability

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, or limits any rights that cannot legally be excluded.

Privacy

Personal information provided when using this website or placing an order will be handled in accordance with the Privacy Policy available on this website.

Changes to these Terms

These Terms and Conditions may be updated from time to time.

The terms applying to your purchase will be those in effect when your order is placed.

Governing law

These Terms and Conditions and any contract between you and Dobrawa Szmyt Designs are governed by the laws of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you will also retain the benefit of any mandatory consumer protections that apply to you under the laws of the part of the United Kingdom in which you live.
